CAA’s “The Celebrate Canada Photo Contest” is sponsored by the CAA Club Group, a not-for-profit Automotive Club operating in various territories of Canada (collectively referred to as, the "CAA") in collaboration with 9778748 Canada Inc. (“Totem” and, together with CAA, collectively hereinafter, the “Sponsors”).
By submitting a photo (the “Photo”), each entrant agrees to these official rules and regulations (“Rules”) and warrants that his/her submission complies with all requirements set out in the Rules.
To be eligible to enter, you must:
(a) be a legal resident of Canada (excluding the province of Quebec);
(b) be of the age of majority or older in your province or territory of residence at the time of submission;
(c) be the sole owner of all right, title and interest (including copyright) in and to the Photo (as defined below), or have the required consents from the owner of the Photo, submitted in connection with the “The Celebrate Canada Photo Contest”.
However, you must not:
(a) be an employee, agent or representative of CAA or Totem, or their respective parent companies or one of their affiliates;
(b) be an employee, agent or representative of CAA’s or Totem’s advertising or promotional agencies;
(c) be an employee, agent or representative of the supplier of the prizes;
(d) be a member of the immediate family of such employee, agent or representative (i.e. brother, sister, child, father, mother) or the legal or de facto spouse of such employee, agent or representative;
(e) be domiciled with such employee, agent or representative.
For winning consideration, the Photo must meet the following criteria (the “Requirements”):
(a) be in digital format;
(b) be high resolution enough to be reprinted in CAA Magazine, at least 8.375” wide by 10.75” high or 2560 x 1950 pixels;
(c) taken in portrait orientation;
(d) be a minimum of 300DPI;
(e) be a Canadian location.
The Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the program must be truthful, complete, accurate and in no way misleading. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
No purchase necessary to enter. There is no limit on the number of entries per person. The contest starts on May 1, 2017 at 12:01 a.m. EST and closes on August 14, 2017 at 11:59 p.m. EST. To enter, you must upload a photo and duly complete and submit the contest entry form located on https://www.canada150.caasco.com/ (the “Website”).
Each Photo submitted will be reviewed by the Sponsors before it may be publically posted on the https://www.canada150.caasco.com site. If he/she opts in, entrants will be notified by email that their Photo is live on the site, once the Photo has been approved. During such review, the Sponsors will not verify whether the Photo submitted meets the Requirements.
The Photo will be declared invalid if: (i) they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled; (ii) mechanically or electronically reproduced; (iii) include images which are incomprehensible, incomplete, inaccurate, misleading, or detrimental to Sponsors’ reputation; (iv) contain illegal, obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content; or (v) otherwise violate the Rules or the spirit of the Rules, all as determined in the Sponsors’ sole discretion.
Sponsors have the right to remove or replace any files that compromise the security of the server, or are otherwise malignant or deemed inappropriate by Sponsors, in their sole discretion.
The CAA Magazine cover “Preview” function in no way depicts how the winning Photo will appear on the cover of CAA Magazine and is subject to the Sponsor’s discretion.
Users of the Website will be able to vote for their favorite Photo published on the Website. Voting is limited to one (1) vote per Photo, per day.
On August 15, 2017, the authors of the top fifty (50) highest-voted Photos will become finalists and their Photos will be submitted to the CAA Magazine judging panel (the “Finalists”). In the event of a tie, the author of the Photo that received the highest amount of votes according to submission time will be considered a Finalist..
The CAA Magazine judging panel will select one (1) Grand Prize winner and twelve (12) Finalist Prize winners among the Finalists, regardless of the number of votes obtained by each Finalist. The selection will be based on the overall visual appeal and creativity of the Finalists’ Photos. All judging criteria will be weighed equally.
There is a total of one (1) Grand Prize (the “Grand Prize”) and twelve (12) Finalist Prizes (each a “Finalist Prize”), as described below.
Grand Prize: The Grand Prize winner will win a Canon EOS Rebel T6 DSLR Camera with EF-S 18-55mm f/3.5-5.6 DC III Lens Kit (approximate value of CDN $599). The Grand Prize winner will also have his/her Photo featured on the cover of the Winter 2017 issue of CAA Magazine and a spot in the 2018 CAA Special Edition Calendar.
Finalist Prize: Each Finalist Prize winner will have his/her Photo featured in the 2018 Special Edition CAA Calendar.
The winners will be notified by phone and/or email starting on August 22, 2017, and will have seven (7) business days to respond and accept their prize. Any winner who does not respond within such delay will be disqualified and the Sponsors reserve their right to select another winner in accordance with these Rules. The Sponsors are not responsible for the failure by the selected entrant to be successfully contacted as described above.
By participating each entrant represents and warrants that: (i) each submitted Photo is an original work created by the entrant; (ii) the submitted Photo has not been published, publicly exhibited or won an award or selected as a winner in any contest, and all rights, title, and interest (including copyright) therein and thereto is owned and/or controlled by the entrant to the full extent necessary to enable the Sponsors to use the Photo as contemplated by these Rules; (iii) all authorizations or exemptions regarding the constituents and subjects of each submitted Photo have been obtained; (iv) each submitted Photo does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity or other statutory or common law rights of any third party; (v) each submitted Photo does not contain any unlawful material, or any material that is libelous, defamatory, profane or obscene, or promotes hatred or discrimination; and (vi) without limiting the generality of the foregoing, each submitted Photo does not disparage the Sponsors or any person or entity involved in the production, implementation, administration or fulfillment of this program.
If a Photo contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in a submitted Photo, the entrant is responsible for obtaining, prior to submission of such Photo, any and all releases and consents necessary to permit the exhibition and use of the Photo in the manner set forth in these Rules without additional consideration. If any person appearing in a Photo is under the age of majority in his/her province or territory of residence the signature of a parent or legal guardian is required on each such release.
Each entrant will indemnify and hold harmless the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of: (i) any violation of the foregoing representations, warranties and obligations; (ii) any violation of these Rules; (iii) any violation or infringement of third party rights including, without limitation, third party intellectual property, privacy and publicity rights; or (iv) any damage related to or in connection with the submitted Photo or the use thereof.
In consideration for their participation in “The Celebrate Canada Photo Contest”, each entrant agrees to assign to the Sponsors and their respective affiliates, on a non-exclusive, perpetual, irrevocable, and royalty-free basis, all intellectual property rights and other property rights in and to the submitted Photos. Each entrant hereby waives and relinquishes such rights in the Photos, including all moral rights. The Sponsors grant to each entrant, on a non-exclusive, perpetual, irrevocable, and royalty-free basis, a license to use their submitted Photos for non-commercial purposes.
Each entrant agrees that Sponsors may, without any additional consideration to the entrant from any party, publish, copy, distribute, broadcast or otherwise use the Photos, for the purposes, in the way and at the frequency determined by the Sponsors in their sole discretion (including without limitation for advertising or commercial purposes), on any medium or support, worldwide and in perpetuity. The Sponsors shall have the right to use the Photos at their discretion, including the right to alter, modify or rearrange such Photos.
By submitting a Photo entrants agree to be bound by these Rules. Entrants further agree to be bound by the decisions of the judges and the Sponsors, which shall be final and binding in all respects, without right of appeal.
Each winner will be required to execute and deliver the Sponsors’ form of agreement and release: (i) confirming compliance with the Rules and confirming that the winning Photo is his/her own original work or has the required consents from the owner of the winning Photo; (ii) releasing the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of the entrant’s submission, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) granting the Sponsors the unrestricted right, in their sole discretion, to publish, without any further consideration, as applicable, his/her name, picture, portrait, likeness, voice and ideas for advertising and promotional purposes. If required by the Sponsors, each winner shall also deliver a model release executed by all individuals depicted in the selected Photo. The agreement and release, and model release if applicable, must be returned within seven (7) days of the notification date indicated on the notification or the selected entrant will be disqualified.
Any submission and any attempt at entering using electronic, computer or other means which are contrary to the spirit of these Rules (e.g., computer pirating, mass e-mailing, etc.) will be automatically rejected and may be referred to the appropriate judicial authorities. Any automated submissions will be noticed and rejected.
In the event of a dispute regarding who submitted a submission form, the submission form will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of submission. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected submission. The sole determinant of the time for the purposes of a valid submission in this will be the server machine(s).
In consideration of having been selected by the CAA Magazine judging panel, each winner authorizes the Sponsors, if required, to use his/her name, photograph, place of residence, voice, image and/or declaration regarding such selection for advertising purposes without any addition consideration. Moreover, the author of the winning Photo agrees to permit his/her name and town of residence to be broadcasted on the CAA website, posted to CAA’s social media channels and published in CAA Magazine or other platforms operated or owned by CAA, without any additional consideration.
The Sponsors will treat all personal information in accordance with applicable privacy laws. It is the intention of the Sponsors that all personal information provided in connection with the “The Celebrate Canada Photo Contest” will be kept confidential and used only for the purposes outlined herein. By submitting their Photo, entrants consent to the use of their personal information for the purposes described herein.
Without limiting the generality of the foregoing, the Sponsors assume no responsibility or liability for lost, late, misdirected or incomplete submissions, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an submission). The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in “The Celebrate Canada Photo Contest” or by any technical or human error which may occur in the processing of submissions. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submissions. The Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Sponsors are not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this program. The Sponsors reserve the right to cancel or terminate this contest at any time and for any reason without notice. In addition, the Sponsors may, in their sole discretion, substitute any of the prizes for other prize of equal or superior value.
“The Celebrate Canada Photo Contest” is void in the province of Quebec and where prohibited by law. Entrants agree that participation thereto is subject to and governed by the laws of the Province of Ontario and the forum for any dispute shall be in the District of Toronto, Ontario. These Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
